Uncontested Divorces
An uncontested divorce is the simplest and most efficient way to legally end a marriage in Ontario. It occurs when both spouses agree on all matters related to their separation, including child custody, support, and division of assets. Since there are no disputes, the process is faster, more cost-effective, and less stressful than a contested divorce.
To qualify for an uncontested divorce, at least one spouse must have lived in Ontario for a minimum of one year before filing. The couple must also be separated for at least one year, unless there are grounds for divorce such as adultery or cruelty.

There are two types of uncontested divorce applications in Ontario: joint divorce and simple divorce. Both options allow couples to end their marriage efficiently, but the process differs depending on whether both spouses apply together or only one spouse initiates the proceedings.
Joint Divorce
A joint divorce is filed when both spouses agree to end the marriage and cooperate in submitting the divorce application. Since both parties are involved in the process from the beginning, there is no need to serve legal documents to the other spouse. Joint divorces are typically processed faster and involve less legal paperwork, making them a preferred option for couples who can work together amicably.
The process starts when both spouses file a Joint Divorce Application with the Ontario Superior Court of Justice. They must also submit an Affidavit for Divorce and, if children are involved, proof of a parenting plan and financial arrangements. The court reviews the application, and if everything is in order, a Divorce Order is granted. The divorce becomes final 31 days after the order is issued.
Joint divorces are ideal for couples who want to avoid unnecessary conflict, reduce legal fees, and finalize their divorce efficiently. At Haider Khan Legal P.C, we assist clients in preparing joint divorce applications, ensuring all agreements comply with Ontario law, and facilitating a smooth process.
Simple Divorce (Uncontested Divorce by One Spouse)
A simple divorce, also known as a simple uncontested divorce is filed by one spouse. It is an option when one spouse initiates the divorce process alone. In this case, the applicant files a Simple Divorce Application with the court and serves the documents to the other spouse. The responding spouse has 30 days to reply, but if they do not contest the divorce, the process continues without a trial or additional legal proceedings.
After the response period ends, the applicant must file an Affidavit for Divorce confirming that the separation meets the legal requirements. A judge will then review the application and, if approved, issue a Divorce Order. The divorce is finalized 31 days after the order is granted.
A simple divorce is appropriate when one spouse is indifferent to the divorce but does not dispute any terms. While it is slightly more complex than a joint divorce due to the requirement of serving legal documents, it remains a relatively quick and cost-effective way to end a marriage.

A Separation Agreement is a crucial document in many uncontested divorce cases. This legally binding contract outlines how both spouses will handle key issues such as child custody, parenting time, spousal and child support, and division of assets and debts. While not mandatory for a divorce application, a well-drafted Separation Agreement can simplify the process by ensuring that all legal and financial matters are settled in advance.
In a joint divorce, a Separation Agreement is typically attached to the application to demonstrate that both parties have already resolved their issues and have agreed on the terms of their separation. For a simple divorce, the applicant may include a Separation Agreement to provide the court with evidence of an amicable settlement, which can help expedite the process.
A Separation Agreement helps prevent future disputes by clearly outlining each spouse’s rights and responsibilities. It also provides financial security and stability, particularly when children are involved. Having a legally sound agreement ensures that both parties are protected and that court intervention is minimized.

An uncontested divorce offers several advantages over a contested divorce. It is generally processed more quickly, reducing the time and emotional strain involved in ending a marriage. The legal fees associated with uncontested divorces are significantly lower, as court appearances and lengthy legal battles are avoided. Additionally, uncontested divorces allow couples to maintain control over important decisions rather than leaving them up to a judge.
