Independent Legal Advice (ILA) ensures that:
You receive unbiased, conflict-free legal guidance.
You fully understand the terms, clauses, and implications of the agreement.
Your agreement is more likely to be enforceable and upheld in court.
Neither party can later claim they were coerced, misled, or unaware of their rights.
Courts in Ontario often set aside family contracts if one or both parties did not obtain ILA. By obtaining a Certificate of Independent Legal Advice, you protect yourself and help ensure the agreement remains binding.

Independent Legal Advice is advice given by a licensed Ontario family lawyer who has no connection to the other party or their lawyer. This independence is crucial—one lawyer cannot represent both parties, even if both parties agree to share one lawyer to reduce costs.
As part of the ILA process, we:
Review your agreement (including separation agreements, prenuptial/marriage contracts, cohabitation agreements, or divorce documents).
Explain every term, clause, and obligation in plain language.
Identify risks and entitlements (e.g., property division, support obligations, tax implications).
Confirm your understanding and that your decision is voluntary and informed.
Issue a Certificate of Independent Legal Advice, making your agreement legally stronger and more enforceable.
Sign on your agreement confirming that legal advice was given, if applicable.
Witness your signature on the agreement.

Your (unsigned) draft agreement. This will be provided to you by your ex-partner or partners lawyer.
Documentation of assets, debts, income, and parenting arrangements (if applicable).
Notices of Assessment for the last three (3) years.
A list of any questions or concerns about specific clauses.
