At Haider Khan Legal, we understand that unpaid invoices and outstanding commercial debts can significantly disrupt cash flow and strain important business relationships. Whether you are a sole proprietor, contractor, service provider, creditor, or corporation, legal remedies may be available when a customer or commercial counterparty fails or refuses to pay an amount owing.

Where the amount claimed exceeds the monetary jurisdiction of the Small Claims Court, an action may be commenced in the Ontario Superior Court of Justice. The Superior Court has jurisdiction to adjudicate claims of any monetary value. Claims for $200,000 or less, excluding interest and costs, are generally governed by the Simplified Procedure under Rule 76 of the Rules of Civil Procedure. Claims exceeding $200,000 ordinarily proceed under the court’s regular procedure.

Below, we outline the principal considerations involved in pursuing unpaid invoices and commercial debts in the Superior Court of Justice.
