Security Enforcement and Recovery
At Haider Khan Legal P.C., we represent secured creditors seeking to enforce security interests in equipment, vehicles, inventory, accounts, and other business or personal property. We assist lenders, lessors, equipment-finance companies, vendors, and other creditors with remedies arising under security agreements and Ontario’s Personal Property Security Act.
-
Our work includes matters involving:
General security agreements;
Equipment leases and finance agreements;
Conditional sales and purchase-money security interests;
Vehicle and machinery financing;
Security over inventory, accounts, and receivables;
Personal and corporate guarantees;
PPSA registrations and competing secured claims; and
Defaults occurring alongside bankruptcy, receivership, or restructuring proceedings.
-
Depending on the agreement, collateral, and default, a secured creditor may be entitled to:
Demand payment and terminate further advances;
Take possession of collateral through lawful means;
Obtain a court order requiring delivery of property;
Seek interim recovery or preservation of identifiable assets;
Dispose of collateral in a commercially reasonable manner after required notice;
Collect or redirect accounts receivable;
Propose to retain collateral in satisfaction of the obligation, where permitted;
Appoint or seek the appointment of a receiver; and
Sue for the debt or any remaining deficiency.
Self-help enforcement must be conducted lawfully and without an unauthorized breach of the peace. Court proceedings may be required where access is refused, ownership is disputed, collateral has been transferred, or urgent preservation relief is necessary.
-
A PPSA registration does not, by itself, resolve every priority dispute. Attachment, perfection, the description of collateral, registration timing, purchase-money status, liens, statutory claims, and insolvency law may affect entitlement. Before enforcement, we review the security documents and registrations, search for competing claims, and assess whether statutory insolvency notices or court approval may be required.
Why Choose Haider Khan Legal?
Secured-creditor remedies are document-driven and time-sensitive. We coordinate demands, asset recovery, litigation, sale procedures, deficiency claims, and priority analysis to protect collateral value and improve the prospects of recovery.
