Before commencing proceedings, we review the contract, invoices, payment history, applicable interest, potential defences, limitation period, debtor identity, and available assets. A formal demand may result in payment, a negotiated repayment plan, or useful admissions concerning the debt.
Where settlement is appropriate, repayment and forbearance agreements should clearly address payment dates, interest, security, default consequences, releases, and enforcement costs.

Claims for up to $50,000, excluding interest and costs, may generally be brought in the Ontario Small Claims Court. Larger or more complex claims may proceed in the Superior Court of Justice. Depending on the evidence and response, available procedures may include default judgment, summary judgment, settlement conferences, mediation, motions, and trial.
A commercial claim may seek principal, enforceable contractual charges, prejudgment and postjudgment interest, damages, and recoverable costs. Claims may also be advanced against guarantors, related parties, or recipients of disputed asset transfers where a proper legal and evidentiary basis exists.

If payment is not made voluntarily, enforcement options may include:
Garnishment of bank accounts or receivables;
Writs of seizure and sale against land or personal property;
Examinations in aid of execution;
Recovery or sale of secured collateral;
Receivership or other equitable relief in appropriate cases; and
Proceedings challenging transfers intended to defeat creditors.
Successful collection depends on more than obtaining judgment. We assess whether the debtor has reachable assets, whether other creditors have priority, and which enforcement method is commercially justified.
