In many RSLA matters, a signed ownership permit from the prior owner is unavailable. In such cases, the Ministry may accept a sworn affidavit in support of the transfer. However, affidavits in this context must accurately and proficiently reflect the legal basis upon which ownership passed, address the absence of traditional transfer instruments, and withstand scrutiny as a substitute for signed documentation. Improperly drafted affidavits, particularly those that oversimplify the lien process or omit material legal context, are a frequent cause of rejection.
