ODSP Disability Claims and Appeals

To qualify for benefits under the Ontario Disability Support Program (ODSP), an applicant must submit necessary medical and financial documentation, among other requirements.

Overview of the Ontario Disability Support Program: Benefits, Application, and Appeals

The ODSP is a financial aid program offering both income support and employment assistance to eligible individuals with disabilities. The income support component provides essential funds to help cover living expenses. For those capable of working and interested in employment, the employment supports benefits in job placement, offers job coaching, and provides necessary tools such as computers, software, transportation, and job-related attire and equipment. The program also supports disabled individuals in starting their own businesses.

The amount you can receive for your ODSP income support is up to $1,308 a month and may be adjusted based on your situation. This income support is also adjusted in July each year, based on inflation.

Applying For ODSP

To be eligible for ODSP as a person with disability you must meet the definition of disability under the Ontario Disability Support Program Act.
 

Being a person with a disability means:

​

  1. you have a substantial mental or physical impairment that is continuous or recurrent, and is expected to last one year or more

  2. the direct and cumulative effect of your impairment results in a substantial restriction in your ability to work, care for yourself, or take part in community life
     

your impairment, its likely duration and restrictions have been verified by an approved health care professional

 

The Law

​

The eligibility criteria for the ODSP are detailed in the Ontario Disability Support Program Act, 1997, S.O. 1997, Chapter 25, Schedule B, specifically from section 3 to section 18. Notably, sections 5(2) and 5(3) of the Act, which previously disqualified individuals with disabilities related to alcohol, drugs, or chemical substances, were repealed in 2021 and will soon no longer apply, thus expanding eligibility.

  • Reside in Ontario;

  • Fulfill financial requirements based on budgetary needs, income sources, and asset values;

  • Meet defined disability criteria;

  • Supply all necessary supporting documentation.
